Terms of Service

1. Acceptance of Terms

Welcome to 58th Floor AI Video ("58th Floor AI Video", "we", "us"). We are an independent individual developer operating under the laws of the People's Republic of China (no registered company). These Terms of Service ("Terms") govern your access to and use of our AI video service — you write a prompt, optionally upload one photo, and receive a short vertical video — available at https://58thflooraivideo.org (the "Service").

By creating an account, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorised to enter into this agreement on behalf of yourself or any organisation you represent.

⚠️ Important: if you do not agree to these Terms, do not use the Service. Continued use after an update constitutes acceptance of the revised Terms.

2. Description of Service

2.1 What we provide. 58th Floor AI Video is an AI-powered service that turns one text prompt — optionally with one reference photo — into a short vertical AI-generated video delivered as a downloadable MP4, with an optional AI-generated original soundtrack. It is a digital software-as-a-service product delivered over the internet. There is no timeline editor and no project system.

2.2 Nature of the Service. The Service is a digital, intangible product. Access is granted immediately once payment is confirmed. Because of this immediate-delivery nature, refunds are subject to the limits in section 7 and the Refund Policy.

2.3 Third-party AI models. Video generation is performed by third-party AI models — the Grok Imagine Video family from xAI, accessed through the SeeAPI gateway. The model used for a run is disclosed on the generation form and on this site. The Service does not silently switch to an undisclosed model: if the model is unavailable, the run fails and its credits are refunded. Your prompt and, if supplied, your photo are sent to that provider only to run your generation. The performance and availability of the Service depend on that provider; a generation that cannot complete is refunded.

3. Accounts

3.1 Account creation. You must provide accurate and complete information when creating an account, and you are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Account security. Report unauthorised use immediately to support@58thflooraivideo.org. Do not share your credentials with any third party. Keep the email address used for billing valid.

3.3 Organisation accounts. If you register on behalf of a company or organisation, you represent that you are authorised to bind that entity.

4. Credits and Packs

The Service uses a credit system. You purchase one-time credit packs — Starter ($5.99, 500 credits) and Creator ($9.99, 1,000 credits) — and credits are consumed per generation. Current packs and pricing are always listed on the pricing page; that page, not this document, carries the live prices.

Credits are an internal unit: the buyer-facing promise is how many clips a pack makes. A typical 9-second clip is charged 500 credits, and the exact cost of a run is shown before you confirm it.

5. Billing and Payment

5.1 Single-purchase authorisation. Every pack purchase is a one-time transaction. By completing a purchase you authorise us to charge your payment method the amount shown at checkout. There is no subscription and no automatic top-up: nothing is ever charged to you again unless you buy another pack.

5.2 Taxes. Prices are exclusive of applicable taxes unless stated otherwise. Where required by law, taxes are collected and remitted by our Merchant of Record at checkout.

5.3 Payment processing. Payments are processed by our Merchant of Record, Waffo Pancake. Card statements show "WAFFO PANCAKE"; invoices are attached to the order confirmation email. Payment card data is handled exclusively by PCI-DSS-compliant payment processors and is not stored on our servers.

6. Credit Validity and Account Termination

6.1 Credit validity. Purchased credits do not expire. There is no auto-top-up to authorise.

6.2 Account termination. If an account is terminated (by you or by us), unused credits remain associated with the account for 30 days, during which they can be refunded under the Refund Policy. After 30 days unused credits expire without refund, unless applicable law requires otherwise.

7. Refund Policy

Our refund rules live in the Refund Policy; that document controls. In summary:

• Window: refund requests can be made within 14 days of purchase — the same window our Merchant of Record enforces for buyer-initiated requests.
• Refundable: unconsumed credits. Not refundable: credits already consumed by video generations you received, because the rendering compute is spent at generation time.
• Duplicate charges: billing errors that result in duplicate charges are refunded in full.
• Statutory rights: where applicable law grants you a withdrawal or refund right (for example the fourteen-day cooling-off right of first-time buyers under EU/UK/Australia consumer law), those rights are preserved in addition to this policy.
• Failed generations are not consumed generations — their credits are returned to your balance automatically.
• How to request: email support@58thflooraivideo.org with your purchase email, order number and reason, or file via the payment provider's consumer portal. We reply within 5 business days; approved refunds go back to the original payment method.

8. Billing Disputes

If you believe a charge is wrong, contact us first at support@58thflooraivideo.org before raising a dispute with your bank. We commit to replying within 2 business days and to resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Output ownership. Subject to these Terms, AI content generated from your inputs ("Output") belongs to you. You may use the Output for any lawful purpose, including posting it on your own channels or using it in commercial work.

9.2 Input licence. By submitting content ("Input"), you grant us a limited, non-exclusive licence to use it solely to provide the Service to you. We will not use your Input to train AI models without your explicit consent.

9.3 Third-party model dependence. The Service relies on third-party AI model providers (see 2.3). Output may be influenced by those models. We do not guarantee any particular output quality and are not liable for content generated by third-party models.

9.4 AI output accuracy. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on it, and for disclosing that it is AI-generated where the law or the platform you post on requires it.

10. Acceptable Use

10.1 Permitted use. You may use the Service only for lawful purposes consistent with these Terms and our Acceptable Use policy.

10.2 Prohibited use. You agree not to use the Service to:

• generate unlawful, defamatory, harassing or fraudulent content;
• generate or spread deepfake content — AI-synthesised video that impersonates real people or is intended to mislead viewers as to its authenticity;
• generate content that sexualises minors or violates child-protection law;
• create malware, phishing content or attack tooling;
• infringe any third party's intellectual property or privacy rights — including uploading photos of people who have not consented;
• bypass or interfere with the Service's security or moderation features;
• resell or sublicense access without prior written approval;
• violate any applicable law, regulation or card-network rule.

10.3 AI-merchant specific prohibitions. You further agree not to:

• use the Service's inputs, outputs, model responses or any derivatives to train, fine-tune, benchmark, distil or otherwise develop any AI or ML model that competes with the Service or with us;
• scrape, extract or collect model outputs at scale for any purpose beyond your own authorised use;
• present AI-generated content as the work of a human professional (such as a licensed doctor, lawyer or financial adviser) in contexts where that could cause harm.

11. Data, Privacy and Security

Your use of the Service is governed by our Privacy Policy. Payment card data is processed exclusively by our PCI-DSS-compliant payment processor (Waffo Pancake) and is not stored on our servers. When you delete your account, your personal information is removed within 30 days, except where a legal exception applies (see the Privacy Policy).

12. Disclaimers and Limitation of Liability

12.1 Disclaimer. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose or accuracy of AI output.

12.2 AI-generated content. ⚠️ AI output may be inaccurate, incomplete or outdated. Do not use it as legal, medical, financial or other professional advice. Always verify with a qualified professional before acting on AI-generated content.

12.3 Limitation of liability. To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential or punitive damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

13. Term and Termination

These Terms apply while you use the Service. We may suspend or terminate your access if you materially breach these Terms, for suspected fraud, or where the law requires it. If we terminate the Service for reasons other than your breach, we will refund the unused, prepaid portion pro rata. You can delete your account at any time through your account settings or by emailing support@58thflooraivideo.org.

14. Governing Law and Disputes

These Terms are governed by the laws of the People's Republic of China (Mainland China). Before starting formal proceedings, please email support@58thflooraivideo.org so we can try to resolve the matter informally.

15. General Terms

We may update these Terms. Material changes will be announced at least 14 days before they take effect, by email where we have your address and by a notice in the Service. Continued use after the effective date constitutes acceptance. If any provision is found unenforceable, the remaining provisions stay in full force. These Terms, together with the Privacy Policy, form the entire agreement between you and us.
